The Court of Appeal sitting in Abuja will on Thursday deliver judgment in the appeal by Governor Abdullahi Sule of Nasarawa state, seeking to set aside the tribunal judgment that nullified his election.
The tribunal had in its judgment delivered on October 2, declared David Ombugadu of the Peoples Democratic Party (PDP) as the winner of the March 18, 2023 governorship election in the state.
Notice of the judgment was contained in a notice issued by the appellate court on Wednesday in Abuja.
Ombugadu had dragged Sule of the All Progressives Congress (APC) to the tribunal, challenging his declaration by the Independent National Electoral Commission (INEC) as winner of the election.
The PDP candidate had complained to the tribunal that his actual votes were unjustifiably reduced while that of Abdullahi Sule of the APC was increased to aid him to victory, particularly in the forms EC8Bs of Gayam and Chiroma Wards of Lafia Local Government Area of the state.
The tribunal chairman, Justice Ezekiel Ajayi, had declared Ombugadu as the lawfully elected governor of Nasarawa state. However, dissatisfied with the decision of the tribunal, Sule filed an appeal at the appellate court, seeking to set aside the decision of the lower court and to affirmed him as the elected governor of Nasarawa state as declared by INEC.
According to INEC, Sule polled a total of 347,209 votes to defeat Ombugadu who secured 283,016 votes.
