The court of appeal sitting in Abuja has upheld the judgment of the governorship election petition tribunal which nullified the election of Abba Yusuf, candidate of the New Nigeria Peoples Party (NNPP) as governor of Kano state.
The tribunal had in its judgment declared Nasiru Gawuna of the All Progressives Congress (APC) as winner of the governorship election.
In a judgment delivered on Friday, a three-member panel of the appellate court held that the NNPP breached the constitution by sponsoring Yusuf who was not a member of the party.
The election petition tribunal led by Justice Oluyemi Osadebay had nullified the election of Yusuf by declaring that 165, 663 of his votes were invalid.
The tribunal held that the ballot papers were not signed nor stamped by the Independent National Electoral Commission (INEC).
The invalid votes were subtracted from the governor’s votes, reducing his votes to
853,939 against the 890,705 scored by Ganuwa.
Dissatisfied with the judgment of the tribunal, Yusuf had headed to the appeal court.
