The Supreme Court has dismissed the appeal by Atiku Abubakar, presidential candidate of the Peoples Democratic Party (PDP), in the February 2023, elections, seeking to annul the election of President Bola Tinubu.
The apex court also dismissed a similar appeal by Peter Obi of Labour Party (LP).  The seven panel of judges led by John Inyang Okoro, in a unanimous judgment dismissed Atiku’s appeal on the grounds that it lacks merit.
The apex court affirmed the judgment of the presidential election petition tribunal which upheld the election of President Bola Tinubu as president.
“This appeal is lacking in merit in the appeal. It is therefore dismissed. The judgment of the lower court declaring Bola Tinubu as duly elected president of Nigeria is affirmed”, Okoro who read the lead judgment declared.
The court also dismissed the appeal by Peter Obi of the LP, noting that the issue raised in the appeal had been decided by the court in March 2023, and therefore, the court cannot repeat itself on a matter a judgment was passed.
